Copyright Policy

1. Respect for Intellectual Property

Sharemysub LLC (“ShareMySub”) respects the intellectual property rights of others, and we expect all users of our services to do the same. It is our policy to respond to notices of alleged copyright or other intellectual property rights infringement that comply with applicable law.

If you believe that your copyrighted work has been used or made available through our platform in a way that constitutes copyright infringement, you may notify us in accordance with:

  • The United States Digital Millennium Copyright Act of 1998 (DMCA, 17 U.S.C. § 512); and/or
  • The European Union E-Commerce Directive 2000/31/EC, including applicable EU Member State implementing legislation.

2. Notice of Claimed Infringement (DMCA Notice)

If you believe that your work has been copied or made available through ShareMySub in a way that constitutes copyright infringement, your written notification must include:

  • A physical or electronic signature of a person authorised to act on behalf of the copyright owner.
  • Identification of the copyrighted work claimed to have been infringed.
  • Identification of the material that is claimed to be infringing, along with information reasonably sufficient to permit ShareMySub to locate the material.
  • Information reasonably sufficient to allow us to contact you (such as an email address, telephone number, or mailing address).
  • A statement that you have a good faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorised to act on behalf of the copyright owner.

Important: If you are unsure whether your rights are being infringed, please seek legal advice before filing a notice. Under 17 U.S.C. § 512(f), you may be liable for damages, including costs and attorneys’ fees, if you knowingly misrepresent that content or activity is infringing.

3. Take Down Procedure

Upon receipt of a valid DMCA Notice, ShareMySub will:

  • Remove or disable access to the allegedly infringing material;
  • Forward the notification to the user who posted the material (“User”); and
  • Take reasonable steps to promptly notify the User that their material has been removed or disabled.

If the notice is incomplete under 17 U.S.C. § 512, but identifies the allegedly infringing work, ShareMySub may reach out to assist you in correcting the notice.

4. DMCA Counter-Notification

If your content has been removed or disabled as a result of a DMCA Notice and you believe this action was a mistake or misidentification, you may submit a Counter-Notification. This must include:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or disabled, and the location where it appeared before removal.
  • A statement, under penalty of perjury, that you have a good faith belief the material was removed due to mistake or misidentification.
  • Your name, address, telephone number, and email address.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district where you are located, or if outside the U.S., of any judicial district in which ShareMySub does business, and that you will accept service of process from the complaining party or their agent.

Upon receipt of a valid Counter-Notification, ShareMySub will:

  • Provide the complaining party with a copy of your Counter-Notification;
  • Inform them that the removed material may be restored within 10 business days; and
  • With public authorities when required by law
  • Restore the material within 10–14 business days, unless our designated agent receives notice that the complaining party has filed an action seeking a court order to restrain the User from engaging in the allegedly infringing activity.

5. Repeat Infringers

In accordance with the DMCA and applicable laws, ShareMySub maintains a policy of terminating, where appropriate, the accounts of users who are determined to be repeat infringers. Such users may also be permanently blocked from submitting new content.

ShareMySub is committed to providing a legal, fair, and secure platform for users to share and manage subscriptions. We strongly respect the intellectual property rights of creators, rightsholders, and businesses, and we will promptly act against any infringement that comes to our attention. Our goal is to maintain a safe, transparent, and lawful environment for all global users.
